Terms of Service

1. Agreement

By creating an account or using the Empasa platform, you agree to these Terms of Service. Empasa is operated by Empasa Technology (“we”, “us”). If you do not agree, do not use the service.

2. The service

Empasa provides AI-powered operations tools for Sharetribe marketplace operators, including analytics, automation, and intelligence features. The service connects to your Sharetribe marketplace via the official Integration API using credentials you provide.

3. Your account

• You must provide accurate account information.
• You are responsible for maintaining the security of your account credentials.
• You must have authority to connect the Sharetribe marketplace(s) you integrate with Empasa.
• One account per person or organization. Do not share credentials.

4. Acceptable use

You agree not to:

• Use Empasa to violate any law or regulation.
• Attempt to access data from marketplaces you do not own or operate.
• Reverse-engineer, scrape, or extract the platform's underlying models or algorithms.
• Use the service to send spam or unsolicited bulk communications.
• Resell or redistribute Empasa access without written permission.

5. Billing and subscriptions

• Free trial: available to new accounts. No credit card required to start.
• Paid plans: billed monthly or annually via Stripe. Prices shown on the pricing page.
• Cancellation: you may cancel at any time. Access continues until the end of the current billing period.
• Refunds: not provided for partial billing periods. If you believe you were charged in error, contact us.
• Price changes: we will notify you at least 30 days before any price increase takes effect.

6. Data and ownership

• Your data remains yours. We do not claim ownership of your marketplace data.
• You grant us a limited license to process your data solely to provide the service.
• On termination, you may request full deletion of your data (see our Privacy Policy).

7. Service availability

We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance when possible. We are not liable for downtime caused by third-party services (Sharetribe, Stripe, hosting providers).

8. Limitation of liability

To the maximum extent permitted by law, Empasa Technology's total liability is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate at any time. We may suspend or terminate your account if you violate these terms. On termination, your access to the platform ceases at the end of your current billing period.

10. Governing law

These terms are governed by the laws of the European Union and the jurisdiction where Empasa Technology is registered. Disputes will be resolved in that jurisdiction.

11. Changes

We may update these terms. Material changes will be communicated via email at least 30 days in advance. Continued use after changes take effect constitutes acceptance.
